Welcome to Breikin. These Terms of Service ("Terms") govern your use of the Breikin website and mobile application (the "Service") operated by Breikin ("us", "we", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
The Breikin Service is designed to provide a platform for personal development and life improvement through AI-powered avatars representing different life categories (Health, Career, Relationships, etc.). The Service helps users track goals, build habits, and receive personalized motivation. The Service is provided "as is" and as available without any warranties, expressed or implied.
In order to use our Service, you may be required to provide certain information. You agree that all information you provide is accurate, complete, and current at all times.

The AI-powered life category avatars, their personalities, characteristics, and all content generated by them are the intellectual property of Breikin. Users may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service except as permitted by these Terms.
Our Service may allow you to post, link, store, share and otherwise make available certain information, text, graphics, videos, goal data, habit tracking information, or other material ("User Content"). You are responsible for the User Content that you post on or through the Service, including its legality, reliability, and appropriateness.
By posting User Content on or through the Service, you grant us the right to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through the Service. You retain any and all of your rights to any User Content you submit, post, or display on or through the Service and you are responsible for protecting those rights.
You represent and warrant that: (i) the User Content is yours or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your User Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

The Breikin Service uses artificial intelligence to generate personalized content, avatar interactions, motivational messages, and life improvement recommendations. While we strive to ensure the quality and appropriateness of AI-generated content, we cannot guarantee that all content will be accurate, complete, or suitable for all users and purposes.
Users acknowledge that AI-generated content may sometimes produce unexpected, inaccurate, offensive, or inappropriate material, despite our best efforts to prevent such occurrences. Breikin is not responsible for any AI-generated content that may be deemed offensive, inappropriate, inaccurate, or otherwise objectionable.
We reserve the right to moderate, edit, or remove any AI-generated content at our sole discretion, without notice or liability. We maintain Safety Mode by default to ensure appropriate content generation.
The advice, suggestions, and recommendations provided by AI avatars are for motivational and educational purposes only and should not be considered professional medical, financial, legal, or therapeutic advice.
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as outlined in our Privacy Policy.
Goal tracking, habit data, and progress information you enter into the Service is used to provide personalized experiences and may be processed by AI to generate recommendations and motivational content.
In no event shall Breikin, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Breikin does not warrant that (i) the Service will function uninterrupted, secure, or available at any particular time or location; (ii) any errors or defects will be corrected; (iii) the Service is free of viruses or other harmful components; or (iv) the results of using the Service will meet your requirements.
The motivational content and life improvement suggestions provided by the Service are not a substitute for professional advice from qualified professionals. Always consult with appropriate professionals for medical, financial, legal, or therapeutic matters.
These Terms shall be governed and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
