Welcome to Breikin. These Terms of Service ("Terms") govern your use of the Breikin website and mobile application (the "Service") operated by Breikin ("us", "we", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
The Breikin Service is designed to help you plan your day, organize tasks into focus blocks, protect rest breaks, and keep a clear view of priorities. The Service helps you create schedules, set reminders, and review progress. The Service is provided "as is" and as available without any warranties, expressed or implied.
In order to use our Service, you may be required to provide certain information. You agree that all information you provide is accurate, complete, and current at all times.
You must be at least 13 years old to use our Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
The Service and its original content, features, and functionality are and will remain the exclusive property of Breikin and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Breikin.
The Service's scheduling tools, layouts, templates, and visual assets are the intellectual property of Breikin. Users may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service except as permitted by these Terms.
Our Service may allow you to post, link, store, share and otherwise make available certain information, text, graphics, schedules, task lists, notes, or other material ("User Content"). You are responsible for the User Content that you post on or through the Service, including its legality, reliability, and appropriateness.
By posting User Content on or through the Service, you grant us the right to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through the Service. You retain any and all of your rights to any User Content you submit, post, or display on or through the Service and you are responsible for protecting those rights.
You represent and warrant that: (i) the User Content is yours or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your User Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

Breikin may provide automated suggestions such as scheduling ideas, reminders, or task ordering based on the information you provide. These suggestions are optional and intended to help you plan more efficiently.
You acknowledge that automated suggestions may be incomplete or inaccurate. You are responsible for reviewing and deciding what to follow, and for ensuring your plans fit your real-world constraints and obligations.
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as outlined in our Privacy Policy.
Task lists, schedules, and progress information you enter into the Service are used to provide core functionality such as planning, reminders, and daily reviews.
In no event shall Breikin, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Breikin does not warrant that (i) the Service will function uninterrupted, secure, or available at any particular time or location; (ii) any errors or defects will be corrected; (iii) the Service is free of viruses or other harmful components; or (iv) the results of using the Service will meet your requirements.
Scheduling or productivity suggestions provided by the Service are not a substitute for professional advice. Always consult with appropriate professionals for medical, financial, legal, or therapeutic matters.
These Terms shall be governed and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
